Welcome to BottleCRM

BottleCRM is Customer Relationship Management (CRM) software designed specifically for startups and small businesses, provided by RunCode Inc. It has an open-source core that anyone can self-host for free, and a hosted app at app.bottlecrm.io with a free plan and paid plans. These Terms of Service ("Terms") govern your use of the BottleCRM software, the hosted app and any related services we provide.

1. Acceptance of Terms

By accessing, downloading, or using BottleCRM software, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our software or services.

• If you disagree with any part, please do not use BottleCRM

2. Software License & Open Source

The open-source core of BottleCRM is distributed under the MIT License, which grants you extensive rights to use, modify, and distribute the software. You may freely download, install, customize, and self-host it without any licensing fees or subscription charges.

What you can do:

• Use BottleCRM for personal or commercial purposes
• Modify and customize the source code
• Distribute copies of the original or modified software
• Self-host on your own servers or cloud infrastructure

3. Free Software Services

The open-source BottleCRM software is provided free of charge with no warranty or guarantee. We make no representations about the software's suitability for your specific business needs. Use at your own risk.

Important Disclaimers for Free Software:

• BottleCRM is provided "as is" without warranty of any kind
• No guarantee of fitness for any particular purpose
• Users are responsible for their own data backup and security
• Community support available through GitHub and forums

4. Paid Professional Services

We offer optional paid services including hosting setup, custom development, data migration, training, and technical support. These services are governed by separate service agreements and payment terms.

Available Paid Services:

• Hosting & Deployment: Professional setup on your preferred cloud platform
• Custom Development: Tailored features and integrations for your business
• Data Migration: Import data from your existing CRM or systems
• Training & Support: Team training and ongoing technical support

Note: Paid services are subject to separate service agreements and payment terms. Contact us for pricing and availability. The hosted app's plans are not one of these services; section 5 covers them.

5. Plans, Billing & Cancellation

This section applies only to the hosted app at app.bottlecrm.io. Self-hosted BottleCRM is outside it, as the last part of this section explains.

Plans and prices

The hosted app has a Free plan and two paid plans, Plus and Pro. A plan belongs to an organization, not to a person, and every plan includes unlimited users and records.

• Free: up to 3 active automation rules, and no custom objects.
• Plus: US$10 a month, up to 10 active automation rules and up to 3 custom objects.
• Pro: US$29 a month, unlimited active automation rules and up to 20 custom objects.

Prices are in US dollars and billed monthly. Sales tax, VAT or GST is added at checkout, depending on where the buyer is located. The current plans are also set out on the pricing page.

We may change the Free plan's limits. We will email the admins of each affected organization at least 30 days before such a change takes effect.

Subscriptions and renewal

A paid plan is a monthly subscription for one organization. It renews automatically each month, and is charged for each month, until it is cancelled. Only an organization admin can buy, change or cancel a plan, from Settings > Billing in the hosted app: Choose opens Stripe Checkout to buy a plan, Switch moves between Plus and Pro, and Manage billing opens Stripe's billing portal for the card, the invoices and cancellation.

Who sells the plans

Paid plans are sold through Link, Stripe's merchant of record (Stripe Managed Payments). Link is the reseller of your subscription, and the payment itself is governed by Link's own terms. Link calculates and collects sales tax, VAT and GST, and emails the receipts and invoices. Your card statement shows LINK.COM* followed by our descriptor. Payment and refund requests are handled by Link support. RunCode Inc. never sees or stores card numbers.

Upgrading

A move from Plus to Pro takes effect at once, and the prorated difference for the rest of the current billing period is charged immediately. If that charge fails, nothing changes and the organization stays on Plus.

Downgrading

A move from Pro to Plus takes effect at the end of the current billing period. Nothing is refunded or credited for the rest of that period.

Cancellation

When a paid plan is cancelled, the subscription ends at the end of the period already paid for, and the organization then moves to the Free plan.

Failed payments

If a renewal payment fails, the organization keeps its plan while Stripe retries the payment over several days. If every retry fails, the subscription is cancelled and the organization moves to the Free plan.

Nothing is deleted on a smaller plan

Moving to a smaller plan, whether by downgrading, cancelling or a failed renewal, never deletes anything. Instead:

• Automation rules above the new plan's limit stop running, the most recently switched-on rules first, until rules are switched off or the plan is raised.
• On the Free plan, custom objects and their records become read-only.
• On the Plus plan with more than 3 custom objects, the existing objects keep working, but no new object can be added.

Refunds

RunCode Inc. does not give refunds for partial months or unused time. Link may refund a payment under its own terms, and Stripe can issue a refund within 60 days of a payment in certain cases. Refunds are also given where the law requires them, and nothing in these Terms limits a refund the law gives you.

Price changes

We may change the price of a paid plan. We will email the admins of each affected organization at least 30 days before a new price applies to an existing subscription.

Self-hosting

Self-hosted BottleCRM, the open-source core under the MIT licence, is outside this section. It has no billing, no plans and no limits on automation rules. Custom objects are a feature of the hosted app and are not part of the open-source core.

6. User Responsibilities

You are responsible for your use of BottleCRM, including compliance with applicable laws, data protection regulations, and proper security practices when self-hosting the software.

Your Responsibilities Include:

• Data Protection: Comply with GDPR, CCPA, and other applicable data protection laws
• Security: Implement proper security measures when self-hosting
• Legal Compliance: Use BottleCRM in accordance with applicable laws
• Proper Use: Do not use the software for illegal or harmful activities

7. Disclaimers & Limitations

BottleCRM is provided "as is" without warranty of any kind. We shall not be liable for any damages arising from the use of our software or services, except as required by applicable law.

Limitation of Liability:

IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

• We are not responsible for data loss or business interruption
• No warranty regarding software performance or reliability
• Users assume all risks associated with software use

9. Changes to These Terms

We may update these Terms of Service from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of BottleCRM after any changes constitutes acceptance of the new terms.

For significant changes affecting paid services, we will provide reasonable notice to existing customers.

10. Governing Law

These Terms, and any dispute arising from them or from the hosted app and our services, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Such disputes are resolved in the state or federal courts located in Delaware, and you and RunCode Inc. consent to their jurisdiction. This does not remove any consumer protection that the law where you live gives you and that a contract cannot waive.

Your use of the open-source code itself is governed by the MIT License under which it is distributed.
